1. Agreement to Terms

By downloading, installing, or using the BetterLook mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

2. Description of Service

BetterLook is a mobile application that provides personalized style recommendations and appearance enhancement suggestions. The App offers features including but not limited to:

  • Personalized style analysis and recommendations
  • Appearance tracking and progress monitoring
  • Style tips and suggestions
  • User profile management

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without prior notice.

3. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

4. User Accounts

To access certain features of the App, you may need to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate your account if any information provided is inaccurate, misleading, or fraudulent.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App in any way that violates any applicable law or regulation
  • Use the App for any fraudulent or deceptive purpose
  • Attempt to gain unauthorized access to any portion of the App
  • Interfere with or disrupt the App or servers connected to the App
  • Upload or transmit viruses, malware, or other harmful code
  • Collect or harvest any information from the App without authorization
  • Use the App to harass, abuse, or harm another person
  • Impersonate any person or entity or misrepresent your affiliation
  • Reverse engineer, decompile, or disassemble any part of the App

6. User Content

You may be able to upload, submit, or transmit content through the App ("User Content"). You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of operating and improving the App.

You represent and warrant that:

  • You own or have the necessary rights to your User Content
  • Your User Content does not violate the rights of any third party
  • Your User Content complies with these Terms and all applicable laws

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable.

7. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by BetterLook, its licensors, or other providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. This license does not include:

  • Any resale or commercial use of the App
  • Any derivative use of the App or its contents
  • Any downloading or copying of account information
  • Any use of data mining, robots, or similar data gathering tools

8. In-App Purchases and Subscriptions

The App may offer in-app purchases or subscriptions. All purchases are processed through the Apple App Store. By making a purchase, you agree to the payment terms presented to you at the time of purchase.

  • All purchases are final and non-refundable unless required by applicable law
  • Subscription fees are billed in advance on a recurring basis
  • You can cancel your subscription at any time through your App Store settings
  • Cancellation takes effect at the end of the current billing period

9. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • The results obtained from using the App will be accurate or reliable
  • Any errors in the App will be corrected

The recommendations provided by the App are for informational purposes only and should not be considered professional advice.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BETTERLOOK, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless BetterLook and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your User Content

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will cease immediately.

You may terminate your account at any time by deleting the App and contacting us to request deletion of your data.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BetterLook operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BetterLook regarding your use of the App and supersede all prior agreements and understandings.
